References in these Terms to “Hazaar”, “we”, “us” or “our” mean Hazaar Limited.

2. About These Terms

These Terms and Conditions apply to your use of the Hazaar website, your access to Hazaar offers and services, and any products you purchase directly from Hazaar.

Hazaar currently makes products available in two ways:

  1. products purchased directly from Hazaar through the Hazaar checkout; and

  2. products discovered through Hazaar but purchased directly from one of our third-party Partner Brands.

Different parts of these Terms apply depending on how you purchase a product.

By using our website, creating an account, verifying your student status, accessing an offer or placing an order directly with Hazaar, you agree to these Terms.

If you follow a link from Hazaar and purchase a product directly from a Partner Brand, your purchase will be subject to that Partner Brand’s own terms and conditions.

Nothing in these Terms affects your statutory rights as a consumer.

 


 

3. How Hazaar Works

Hazaar is a fashion discovery, student offers and ecommerce platform.

We feature selected products, brands, student discounts, editorial content, recommendations, campaigns and promotional offers.

3.1 Hazaar Products

Where you add a product to your basket and complete payment through the Hazaar checkout, Hazaar Limited is the seller.

We refer to these products as “Hazaar Products”.

Your contract for the purchase is with Hazaar, even where the product is stored, packed or dispatched directly by one of our supplier or brand partners on our behalf.

Some Hazaar Products are therefore fulfilled using a dropship model, but Hazaar remains responsible for your purchase as the seller.

You should contact Hazaar if you have a question or problem relating to a Hazaar Product.

3.2 Partner Brand Products

Some products displayed on Hazaar are not sold by us.

We refer to these as “Partner Brand Products”.

When you select a Partner Brand Product, you will be directed away from Hazaar to the website of the relevant third-party retailer or brand, which we call a “Partner Brand”.

Partner Brand Products cannot be added to a Hazaar basket and are not purchased through the Hazaar checkout.

If you complete a purchase on a Partner Brand’s website:

  • the Partner Brand is the seller;

  • your contract is with the Partner Brand, not Hazaar;

  • payment is made to the Partner Brand or its payment provider;

  • the Partner Brand is responsible for fulfilment and delivery;

  • the Partner Brand’s returns and refund policy applies; and

  • your purchase is subject to the Partner Brand’s own terms and privacy policy.

3.3 Identifying Who You Are Buying From

We aim to make it clear whether you are purchasing a Hazaar Product or being directed to a Partner Brand.

Where you complete payment through the Hazaar checkout, Hazaar is the seller.

Where a button or link takes you to another brand’s website to complete your purchase, that Partner Brand is the seller.

Buttons may use wording such as:

  • “Shop the Collection”;

  • “Shop at [Brand]”;

  • “Shop Now”; or

  • similar wording that directs you to a Partner Brand website.

You should check the seller and the information displayed before completing any purchase.

 


 

4. Who Can Use Hazaar

You may browse Hazaar subject to these Terms.

Student verification and student-only offers are available to eligible students aged 16 or over.

You must be able to provide one of the verification methods accepted by Hazaar or our verification provider, which may include:

  • a valid .ac.uk academic email address;

  • a valid student ID; or

  • another approved form of student verification.

You must be at least 18 years old to enter into a purchase contract with Hazaar independently.

If you are under 18, an order for a Hazaar Product may only be placed with the permission and supervision of a parent or legal guardian who accepts responsibility for that order.

Partner Brands may apply their own minimum age or eligibility requirements to purchases made on their websites.

Hazaar Products are intended for private and domestic use.

We may refuse or cancel an order where we reasonably believe that products are being purchased for unauthorised resale or other commercial purposes.

 


 

5. Student Verification

Certain prices, discount codes, offers, collections, promotions and other benefits available through Hazaar are restricted to verified students.

We use a third-party verification provider, GoCertify, to support our student verification process.

You may be required to provide information to GoCertify or use one of its verification methods to confirm your eligibility.

Your use of GoCertify’s verification services may also be subject to GoCertify’s own applicable terms and privacy information.

5.1 Verification Period

Once successfully verified through Hazaar, your student verification status will normally remain valid for 12 months.

During that period, your verified status can be used to access eligible student offers available across Hazaar and our Partner Brands without requiring you to complete the full verification process for every individual brand.

Individual offers may still have their own conditions and eligibility requirements.

After your verification period expires, you may be required to verify your student status again.

5.2 Verification Misuse

You must provide accurate and genuine information when verifying your student status.

If we reasonably believe that:

  • verification information is inaccurate or fraudulent;

  • another person is using your verified status;

  • your student status is no longer valid;

  • discount codes are being collected or distributed improperly;

  • our verification system is being manipulated; or

  • student benefits are otherwise being misused,

we may suspend or revoke your verification status before the end of the 12-month period.

We may also restrict access to offers, cancel affected Hazaar orders where legally permitted, suspend an account or take other reasonable steps to prevent misuse.

 


 

6. Student Discount Codes and Partner Brand Offers

Hazaar provides verified students with access to offers and discount codes from selected Partner Brands.

Unless an offer states otherwise, discount codes provided through Hazaar are unique and single-use.

A code issued to you is for your own use.

You must not:

  • sell a code;

  • share a unique code with another person;

  • publish a code online;

  • post a code on a voucher or discount website;

  • reproduce or distribute codes;

  • obtain codes using automated methods; or

  • otherwise attempt to circumvent the eligibility restrictions attached to an offer.

We may invalidate codes or suspend access to student offers where we reasonably suspect misuse.

6.1 Offer-Specific Terms

Partner Brand offers may have additional terms and restrictions.

These may include:

  • minimum spend;

  • expiry dates;

  • excluded products or categories;

  • sale exclusions;

  • geographic restrictions;

  • limits on use;

  • restrictions on combining offers;

  • new-customer restrictions; or

  • other Partner Brand conditions.

The applicable offer terms will normally be displayed when you access or unlock your code, including through the GoCertify verification experience.

You should read these terms before using your code.

The terms displayed for an individual offer form part of the conditions on which that offer is made available.

 


 

7. If a Partner Brand Code Does Not Work

We make reasonable efforts to ensure that the Partner Brand offers displayed on Hazaar are accurate and available as described.

However, Partner Brands control their own websites, checkout systems and application of discount codes.

If an offer or code does not work as described, please contact Hazaar and we will take reasonable steps to investigate the issue and, where appropriate, raise it with the relevant Partner Brand.

Unless required by law, Hazaar cannot guarantee that a Partner Brand will:

  • accept a particular discount code;

  • honour an expired, withdrawn or incorrectly used offer;

  • retrospectively apply a discount after a purchase has been completed; or

  • refund the difference where an order has already been placed without the discount.

This does not remove Hazaar’s responsibility for ensuring that offers and pricing presented by Hazaar are not misleading.

 


 

8. Product Information

We make reasonable efforts to ensure that product information displayed on Hazaar is accurate.

This may include:

  • product descriptions;

  • images;

  • sizes;

  • colours;

  • prices;

  • student prices;

  • discounts;

  • availability;

  • brand information; and

  • offer details.

However:

  • colours may appear differently depending on your screen or device;

  • packaging may vary from images shown;

  • sizing may vary between brands;

  • sizing guides are estimates;

  • minor product variations may occur;

  • stock can change quickly; and

  • Partner Brands may update their product information, prices or availability.

All products are subject to availability.

 


 

9. Partner Brand Prices and Student Prices

Hazaar may display a Partner Brand’s standard selling price and/or an estimated or calculated student price after applying an available Hazaar student offer.

For example, where a Partner Brand provides verified Hazaar users with 20% off an eligible product, Hazaar may show the resulting student price on the relevant product card or page.

Any student price displayed is subject to:

  • successful student verification;

  • the terms of the relevant offer;

  • product eligibility;

  • availability; and

  • the Partner Brand continuing to offer the relevant price and discount.

Because Partner Brands control their own websites and pricing, prices may occasionally change before Hazaar is updated.

You should check the final product price and discount shown on the Partner Brand’s website before completing your purchase.

If you notice a material price or offer discrepancy, please let us know so that we can investigate and correct our information where necessary.

For Hazaar Products, the price and any compulsory charges payable to Hazaar will be shown before you complete checkout.

 


 

10. Orders for Hazaar Products

This section applies only where Hazaar is the seller.

When you place an order through the Hazaar checkout, you are making an offer to purchase the relevant Hazaar Products from us.

After you place your order, we will normally send you an acknowledgement confirming that we have received it.

This acknowledgement does not necessarily mean that your order has been accepted.

Unless we tell you otherwise, a binding contract is formed when we send you confirmation that the relevant product has been dispatched.

If products within one order are dispatched separately, a separate contract may be formed for each product when its dispatch is confirmed.

We may refuse or cancel a Hazaar order before dispatch where reasonably necessary, including where:

  • a product is unavailable;

  • payment cannot be authorised;

  • fraud is suspected;

  • student verification has been misused;

  • a promotional code has been misused;

  • incorrect pricing or product information has been displayed;

  • delivery restrictions apply;

  • required information has not been provided; or

  • we reasonably believe that an order is being placed for resale.

If payment has already been taken for a Hazaar order that we cancel, we will refund the amount paid for the cancelled product.

 


 

11. Made-to-Order Hazaar Products

Some Hazaar Products may be manufactured, printed or prepared after you place your order.

Where this applies, this will normally be identified on the relevant product page together with any longer production or dispatch times.

The fact that a standard product is produced after an order is placed does not by itself remove your statutory cancellation rights.

However, statutory cancellation rights may not apply where goods are:

  • made specifically to your individual specifications; or

  • clearly personalised for you,

where an applicable legal exception applies.

Any relevant restriction will be made clear before you complete your purchase.

We do not currently offer pre-orders or back-orders unless expressly stated otherwise.

 


 

12. Pricing and Payment for Hazaar Products

Prices shown for Hazaar Products include VAT where applicable unless clearly stated otherwise.

Any compulsory delivery charges or other compulsory charges will be shown before you place your order.

We accept the payment methods displayed at checkout.

Payment may be taken when you place your order.

We use third-party payment providers to process payments securely and do not store your full payment card details.

We may carry out reasonable:

  • payment authorisation checks;

  • fraud checks;

  • student eligibility checks;

  • account checks; and

  • order validation checks.

We may contact you where reasonably necessary to complete these checks.

If a payment provider refuses or reverses a payment, we may be unable to accept or fulfil the order.

 


 

13. Klarna

We may offer Klarna as a payment option for eligible Hazaar purchases.

If you choose to use Klarna, your use of Klarna’s payment services will be subject to the terms, eligibility requirements and privacy information provided by Klarna.

Availability of a particular Klarna payment option is determined by Klarna and may depend on eligibility checks.

Using Klarna does not change the identity of the seller.

Where you purchase a Hazaar Product using Klarna, Hazaar remains the seller of the goods and these Terms continue to apply to the purchase itself.

Questions relating specifically to your Klarna payment arrangement may need to be directed to Klarna.

 


 

14. UK Delivery for Hazaar Products

Hazaar currently accepts orders for Hazaar Products for delivery within the United Kingdom only, unless we expressly state otherwise.

Available delivery methods, charges and estimated timescales will be shown on the product page, at checkout or otherwise communicated before purchase.

Some Hazaar Products are dispatched directly to you by the relevant supplier or brand partner under our dropship model.

Where this happens, Hazaar remains the seller.

You must provide complete and accurate delivery information.

Delivery dates and timescales are estimates unless we expressly agree otherwise.

If circumstances outside our reasonable control delay an order, we will take reasonable steps to minimise the impact and keep you informed where appropriate.

This does not affect any rights you have under consumer law.

 


 

15. Delivery of Partner Brand Products

Hazaar does not fulfil or deliver Partner Brand Products purchased directly from a Partner Brand.

Delivery availability, charges, locations, restrictions and timescales are determined by the relevant Partner Brand.

Although Hazaar currently sells Hazaar Products within the UK only, users outside the UK may be able to browse Hazaar, complete student verification and access Partner Brand offers where:

  • they satisfy Hazaar’s verification requirements; and

  • the relevant Partner Brand allows purchases or delivery in their location.

You should check the Partner Brand’s own delivery terms before purchasing.

 


 

16. Risk and Ownership of Hazaar Products

Hazaar Products remain at our risk until they come into the physical possession of you or another person you have nominated to receive them.

Ownership of the goods passes to you once payment has been received in full and the goods have been delivered, unless applicable law requires otherwise.

 


 

17. Cancelling and Returning Hazaar Products

This section applies only where Hazaar is the seller.

Nothing in this section affects your statutory rights.

If you are a UK consumer purchasing goods online, you will generally have a right to cancel your purchase within 14 days beginning on the day after you receive the goods, subject to applicable legal exceptions.

To exercise your right to cancel, you must tell us within the applicable cancellation period.

After notifying us of your cancellation, you must normally return the goods within the period required by law.

To arrange a return, please follow the return instructions provided for the relevant product or contact Hazaar customer support.

Returned products should normally be:

  • unworn;

  • unused;

  • in their original condition;

  • returned with relevant tags;

  • returned with hygiene seals intact where applicable; and

  • appropriately packaged.

You may inspect a product to the extent reasonably necessary to establish its nature, characteristics and functioning.

Where handling beyond this causes a reduction in value, we may make an appropriate deduction from your refund where permitted by law.

 


 

18. Brand-Specific Shipping and Returns Policies

Different Hazaar Products may be fulfilled by different supplier or brand partners.

As a result, some products may have different:

  • delivery methods;

  • estimated dispatch times;

  • return instructions;

  • return addresses;

  • return charges; or

  • additional commercial return periods.

Any relevant brand-specific arrangements will be displayed on the product page, in our Returns information or otherwise made available before or after purchase as appropriate.

Brand-specific policies may provide rights that are in addition to your statutory rights.

They do not reduce or remove rights you have under applicable consumer law.

 


 

19. Refunds for Hazaar Products

Refunds for Hazaar Products will normally be made to your original payment method.

Where you exercise a statutory right to cancel, we will provide your refund within the period required by applicable law.

Where permitted by law, we may wait until we receive the returned goods or evidence that they have been sent back before issuing the refund.

Where required by law, we will also refund the cost of our standard delivery option.

If you selected a more expensive delivery option, we are not required to refund the amount above the cost of standard delivery unless otherwise required by law.

Where a prepaid returns service is used for a non-faulty return, an applicable return charge may be deducted from your refund where this was made clear to you.

Any refund will reflect the amount you actually paid after discounts were applied.

 


 

20. Products That May Not Be Returnable

Your statutory cancellation rights are subject to certain legal exceptions.

Unless goods are faulty, damaged, not as described or another legal right applies, cancellation rights may not apply to products such as:

  • products made to your individual specifications;

  • clearly personalised products;

  • sealed goods that are unsuitable for return for health or hygiene reasons once unsealed; or

  • other categories excluded from statutory cancellation rights.

Where a relevant exception applies, we will aim to make this clear before purchase.

A product will not be treated as non-returnable merely because it is on sale.

Sale products continue to benefit from applicable statutory consumer rights.

 


 

21. Faulty, Damaged or Incorrect Hazaar Products

Hazaar Products must meet the standards required by applicable consumer law.

This includes relevant requirements that goods are:

  • of satisfactory quality;

  • fit for their intended purpose; and

  • as described.

If a Hazaar Product is faulty, damaged, unsafe, counterfeit, incorrect or not as described, please contact us.

Depending on the circumstances and your legal rights, an appropriate remedy may include:

  • repair;

  • replacement;

  • refund; or

  • price reduction.

Nothing in these Terms limits your rights under the Consumer Rights Act 2015 or other applicable consumer law.

 


 

22. Returns and Problems With Partner Brand Products

Where you purchase a Partner Brand Product directly from a Partner Brand, the Partner Brand is responsible for:

  • accepting your order;

  • taking payment;

  • fulfilment;

  • delivery;

  • cancellations;

  • returns;

  • refunds;

  • faulty or damaged goods; and

  • product-related customer service.

Hazaar cannot normally issue a refund for money paid directly to a Partner Brand because Hazaar has not received that payment.

If you contact us about a Partner Brand purchase, we may try to help identify the appropriate contact or raise an issue with the Partner Brand where appropriate.

Any assistance provided by Hazaar does not make Hazaar the seller of the product or responsible for performing the Partner Brand’s obligations.

 


 

23. Affiliate Links and How Hazaar Makes Money

Some links, products, collections and offers displayed on Hazaar are provided as part of commercial relationships with Partner Brands.

These may include affiliate links or other tracked links.

If you follow one of these links and make a qualifying purchase, Hazaar may receive a commission or other payment from the Partner Brand or an affiliate network.

This does not normally increase the price you pay.

Hazaar may also receive payment from brands for:

  • sponsored campaigns;

  • featured placements;

  • homepage visibility;

  • editorial partnerships;

  • CRM activity;

  • creator campaigns;

  • social media activity;

  • events; or

  • other marketing services.

Where content or placement constitutes paid advertising or sponsored marketing, we will identify the commercial nature of that content where required.

24. Recommendations, Rankings and Editorial Content

Hazaar curates products and brands that we believe are relevant to our audience.

Recommendations and the order in which products or brands appear may be influenced by a mixture of factors including:

  • genuine customer behaviour;

  • clicks and engagement;

  • sales or conversion information;

  • popularity;

  • product relevance;

  • trends;

  • Hazaar editorial judgement;

  • product availability;

  • student value;

  • commercial partnerships; and

  • sponsored placements.

The fact that Hazaar may earn affiliate commission from a product does not necessarily mean that the recommendation itself is sponsored.

Where we use descriptions such as “Hazaar Picks”, these may reflect editorial selection by the Hazaar team.

Where we use descriptions that imply measurable customer behaviour or performance, such as “Trending”, “Popular” or “Best Sellers”, we will aim to have a reasonable basis for that description.

Sponsored or paid-for placements may also appear alongside editorial recommendations and will be identified where appropriate.

 


 

25. Promotions, Prize Draws and Giveaways

From time to time Hazaar may operate:

  • promotions;

  • discount codes;

  • competitions;

  • prize draws;

  • giveaways;

  • referral campaigns;

  • early-access offers; or

  • other promotional activity.

Individual campaigns may be subject to separate promotional or Prize Draw Terms and Conditions.

Where separate terms are provided, those terms apply in addition to these Terms and will take precedence in relation to that specific promotion where there is a conflict.

Unless stated otherwise:

  • offers cannot be combined with other promotions;

  • exclusions may apply;

  • promotions may be limited per person, account, household, order or payment method;

  • offers have no cash alternative; and

  • promotional benefits may not be transferred, sold or reproduced.

We may withdraw or amend a promotion where reasonably necessary, subject to applicable law and any rights already acquired.

Entering a promotion does not by itself override your marketing preferences or the requirements applicable to marketing communications.

 


 

26. Reviews

Hazaar may introduce functionality allowing users to submit reviews, ratings or feedback about products, brands or their experiences.

If you submit a review, you must ensure that it:

  • reflects your genuine experience or opinion;

  • is not fake or misleading;

  • does not impersonate another person;

  • does not infringe another person’s rights; and

  • discloses any incentive, payment, gift or other material connection where disclosure is required.

You must not submit or arrange fake reviews or attempt to manipulate ratings or review systems.

We may moderate, reject or remove reviews where we reasonably believe they breach these Terms, applicable law or our review standards.

 


 

27. User and Creator Content

Hazaar may feature photographs, videos, social media posts, styling content, testimonials or other content created by customers, students and creators.

Content produced for Hazaar by employees, contractors, agencies or creators working under an individual agreement may be governed by separate contractual terms.

27.1 Organic User Content

If you tag Hazaar, including @justhazaar, or otherwise mention us in content, this does not automatically transfer ownership of your content to Hazaar.

Where we would like to use your content on our website, social channels, marketing or other commercial materials, we may contact you to request permission.

If you agree, the use of your content may be subject to additional UGC permission terms provided to you at that time.

You remain responsible for ensuring that you have the right to share the relevant content and that it does not infringe another person’s copyright, privacy or other rights.

 


 

28. Content Submitted Directly to Hazaar

Where you deliberately submit content to Hazaar for publication or marketing use under terms which expressly permit us to use it, you confirm that:

  • you created the content or have permission to provide it;

  • you have permission from identifiable people appearing in the content where required;

  • it does not infringe intellectual property, privacy or other rights;

  • it is not unlawful, defamatory, threatening, discriminatory or abusive; and

  • it does not contain malware or harmful material.

Any licence granted to Hazaar will be governed by the terms presented to you when the content is submitted or permission is obtained.

You retain ownership of your content unless a separate agreement expressly states otherwise.

 


 

29. Accounts

If you create a Hazaar account, you are responsible for:

  • providing accurate information;

  • keeping your login information secure;

  • keeping your contact details up to date; and

  • preventing unauthorised use of your account.

You should notify us if you believe your account has been accessed without permission.

We may suspend, restrict or close an account where we reasonably believe there has been:

  • fraud;

  • security risk;

  • misuse of student verification;

  • misuse of discount codes;

  • automated abuse;

  • unauthorised resale; or

  • a serious or repeated breach of these Terms.

 


 

30. Acceptable Use

You must not use Hazaar:

  • unlawfully or fraudulently;

  • to transmit malware or malicious code;

  • to interfere with our website or security systems;

  • to circumvent student verification;

  • to harvest or scrape unique discount codes;

  • to misuse promotions;

  • to access another user’s account without permission;

  • to collect personal information without authority;

  • to infringe another person’s rights; or

  • to submit false, misleading, abusive or harmful material.

You must not systematically scrape, copy or extract Hazaar’s product, pricing, editorial or offer information for commercial use without our permission.

We may suspend or restrict access to the website where reasonably necessary for legal, security, operational or business reasons.

 


 

31. Intellectual Property

Unless otherwise stated, the Hazaar website and its original content, including our:

  • branding;

  • trademarks;

  • text;

  • graphics;

  • site design;

  • layout;

  • editorial content;

  • software; and

  • original creative materials

are owned by Hazaar or used by us under licence.

Partner Brand names, logos, trademarks, product photography and other brand materials remain the property of their respective owners or licensors.

You may use the Hazaar website for personal, non-commercial purposes.

You must not reproduce, distribute, commercially exploit, republish or misuse our intellectual property without permission.

 


 

32. Third-Party Websites and Services

Hazaar may link to websites, platforms and services operated by third parties, including:

  • Partner Brands;

  • GoCertify;

  • Klarna;

  • affiliate networks;

  • payment providers;

  • ticketing providers;

  • social media platforms; and

  • other technology providers.

Third-party websites are controlled by their respective operators and may be subject to their own terms and privacy policies.

Hazaar is not responsible for the content or availability of third-party websites.

This does not exclude any responsibility Hazaar has under applicable law for Hazaar’s own actions, advertising, representations or commercial practices.

Shopify

Our website and ecommerce services are hosted and supported by Shopify. Shopify processes information relating to your use of Hazaar to provide its services to us, including certain Enhanced Services where Shopify Network Intelligence is enabled. These services may use information about interactions with Hazaar, Shopify and other Shopify merchants to support functionality including analytics, personalisation and advertising. Further information is available in our Privacy Policy and Shopify's own privacy information.

 


 

33. Events

Hazaar may organise or promote events, including student events, activations, parties, community events or other experiences.

Tickets or registrations may be provided through third-party ticketing platforms such as Eventbrite, Fatsoma or other providers.

Where this happens, your use of the ticketing platform and your ticket purchase or registration may be subject to the relevant provider’s terms.

Individual Hazaar events may also have separate event-specific terms, eligibility requirements or conditions of entry.

 


 

34. Marketing Communications and Mobile Messaging

You may choose to receive marketing communications from Hazaar, including by email or SMS.

Accepting these Terms does not by itself constitute consent to receive marketing communications.

Where required by law, we will only send marketing through a particular channel where we have the necessary permission or another lawful basis applies.

You can unsubscribe from email marketing using the unsubscribe link provided in our emails.

Where you receive SMS marketing from Hazaar, you can opt out using the unsubscribe mechanism provided, including by replying STOP where supported.

Opting out of marketing does not prevent us from sending necessary non-marketing communications relating to a service or transaction, such as:

  • verification codes;

  • security messages;

  • account information;

  • order confirmations;

  • delivery updates; or

  • refund notifications.

Separate Mobile Messaging Terms may also apply where you sign up to our SMS service.

35. Privacy, Cookies and Affiliate Tracking

Our collection and use of personal data is governed by our Privacy Policy.

36. Our Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

This includes liability for:

  • fraud or fraudulent misrepresentation;

  • breach of statutory consumer rights; or

  • any other liability that cannot legally be excluded.

36.1 Hazaar Products

Where Hazaar is the seller, we are responsible for foreseeable loss or damage caused by our breach of these Terms or failure to use reasonable care and skill.

We are not responsible for loss or damage that was not reasonably foreseeable or which results from your misuse of a product.

Where you use Hazaar as a consumer, we are not responsible for business losses including loss of profit, business interruption or loss of commercial opportunity.

36.2 Partner Brand Products

Where you purchase directly from a Partner Brand, Hazaar is not responsible for that Partner Brand’s performance of its sales contract with you.

This may include the Partner Brand’s:

  • payment processing;

  • fulfilment;

  • delivery;

  • cancellations;

  • returns;

  • refunds; and

  • contractual warranties.

This does not exclude responsibility Hazaar has under applicable law for our own acts, omissions, advertising, representations or commercial practices.

Nothing in these Terms affects your statutory consumer rights.

 


 

37. Events Outside Our Reasonable Control

We will not be responsible for a failure or delay in performing an obligation where it is caused by events outside our reasonable control.

Examples may include:

  • courier disruption;

  • severe weather;

  • natural disasters;

  • industrial action;

  • telecommunications outages;

  • internet outages;

  • customs delays;

  • government restrictions; or

  • other circumstances we could not reasonably prevent.

Where such circumstances affect a Hazaar order, we will take reasonable steps to minimise the impact and comply with applicable consumer law.

 


 

38. Changes to Hazaar or These Terms

Hazaar’s business, services and Partner Brand relationships may change over time.

We may update these Terms to reflect changes to:

  • our business model;

  • our products or services;

  • our Partner Brand relationships;

  • our verification process;

  • technology;

  • applicable law; or

  • operational requirements.

The latest version will be published on our website and will show the date on which it was last updated.

Where a material change affects an existing contractual relationship with you, we may take additional reasonable steps to notify you.

Changes to these Terms will not retrospectively remove rights you have already acquired under an existing purchase contract.

 


 

39. General

If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.

If we delay or fail to enforce a right under these Terms, this does not mean that we have waived that right.

We may transfer our rights or obligations as part of a merger, sale, restructuring or other business transfer, provided doing so does not reduce your existing consumer rights.

Nothing in these Terms creates a partnership, employment relationship or joint venture between you and Hazaar.

Except where applicable law provides otherwise, no person other than you and Hazaar has the right to enforce these Terms.

These Terms, together with any policies or additional terms expressly referred to in them, form the agreement between you and Hazaar relating to your use of our website and any products purchased directly from Hazaar.

A purchase made directly from a Partner Brand forms a separate contract between you and that Partner Brand.

 


 

40. Governing Law and Courts

These Terms are governed by the laws of England and Wales.

If you are a consumer living in England or Wales, legal proceedings relating to these Terms may be brought in the courts of England and Wales.

If you live in Scotland or Northern Ireland, you may also have rights to bring proceedings in your local courts.

Nothing in this section limits any mandatory rights you have under applicable consumer law.
